Terms & Conditions Anema GmbH

Scope

These General Terms and Conditions govern the content, conclusion, and execution of contracts between Anema GmbH and the customer in connection with the purchase of products through the web shop. By placing an order, the customer accepts these General Terms and Conditions.

Sales Offer

Anema GmbH strives to depict the products in the web shop as accurately as possible. However, the color and size of the displayed products may differ from the original product due to different screen settings.

Changes to the products and the correction of any errors in the price or product description are reserved at any time. Errors in the publication of the products do not entitle the customer to the actual delivery of these products.

Order and Conclusion of Contract

• The published products on the web shop www.experwiser.com do not constitute a purchase offer but an invitation to order.
• Anema GmbH accepts the order by sending a confirmation email to the customer. The contract is concluded with the confirmation email.
• The customer undertakes to provide truthful information when placing the order.
• Minors or persons not fully capable of acting confirm with the order that they have the consent of their legal representative to conclude the corresponding transaction.

Payment Methods, Prices, and Shipping

• The customer’s payment is generally made via PayPal, Apple Pay, Google Pay, credit card, prepayment (bank transfer), or cash payment upon collection. The ordered goods will only be shipped after the amount has been credited to Anema GmbH’s account. Anema GmbH issues an invoice for the ordered goods, which is enclosed with the delivered goods.
• In the case of prepayment, the invoice must be paid within 5 working days to the following account:

• The prices are in CHF (Swiss Francs) and include the statutory VAT of 8.1%.
• For each delivery (registered mail with A-Post or A-Post+), different shipping costs apply depending on the country, which are paid by the customer.

Delivery of Ordered Products

• The ordered products are delivered to the countries that can be set in the shop.
• Delivery is generally made after receipt of payment.
• Until full payment is made, the product remains the property of Anema GmbH.
• Products are delivered as quickly as possible. A maximum of 10 working days is aimed for the product to arrive at the customer.
• In case of delays, the customer will be informed directly by email.

Collection of Ordered Products

Collection of ordered products is not possible.

Return Policy

• The customer can withdraw from their contract declaration within 14 days by either notifying Anema GmbH in writing via email or by returning the product. The period begins upon receipt of the goods and is maintained by timely sending the email or returning the product.
• The customer bears the costs for the return shipment to Anema GmbH, Dennliweg 76a, 4900 Langenthal, Switzerland.
• Only unused products in perfect condition and in their original packaging will be accepted. Anema GmbH expressly reserves the right to demand compensation for any loss in value. The customer can avoid the obligation to compensate for any loss in value by not using the product and refraining from anything that could impair its value.
• Once Anema GmbH confirms receipt of the return shipment, the customer has the option to receive a refund, order another product of the same value, or receive a voucher from Anema GmbH.
• Products from promotions are not accepted for return.

Complaints, Defects, Transport Damage

The customer must inspect the product for damage and any defects immediately upon receipt and notify Anema GmbH in writing via email with a photo. The costs of the return shipment are borne by the customer. Anema GmbH assumes no liability for damages caused by improper use.

Retention of Title

The product remains the property of Anema GmbH until full payment is made.

Warranty Services

Anema GmbH grants a warranty of 24 months from the delivery of the product. Products that have been used improperly are excluded.

Data Protection

Customer data received through the web shop is treated strictly confidentially. It is used exclusively for processing the order, stored, processed, and used for subsequent customer care purposes, and not passed on to third parties.

Based on Article 13 of the Swiss Federal Constitution and the data protection provisions of the Federal Data Protection Act (DSG), every person has the right to privacy protection and protection against misuse of their personal data. Anema GmbH treats personal data strictly confidentially and does not pass it on to third parties.

In close cooperation with hosting providers, Anema GmbH strives to protect the databases as well as possible against unauthorized access, loss, misuse, or forgery.

When accessing the Anema GmbH website, the following data is stored in log files: IP address, date, time, browser request, and generally transmitted information about the operating system or browser. This usage data forms the basis for anonymous statistical evaluations, so that trends can be identified, allowing Anema GmbH to improve its offerings accordingly.

Final Provisions

• Should these AGB or parts thereof be invalid, the validity of the remaining provisions shall not be affected.
• Any general terms and conditions of the customer are expressly excluded.
• Anema GmbH may change the AGB at any time without notice.

Applicable Law and Jurisdiction

• The legal relationship between Anema GmbH and the customer is subject to Swiss law.
• The ordinary courts in the Canton of Bern have jurisdiction.
